Nirmaara is a construction-professional discovery and connection platform operated by HungryNow Innovations Private Limited ("Nirmaara", "Company", "we", "us" or "our").

Nirmaara enables customers to discover, evaluate, shortlist and connect with architects, contractors, labour contractors and other construction professionals.

Nirmaara is designed around the journey: Discover → Evaluate → Shortlist → Connect.

By accessing, registering on, browsing, or using the Nirmaara website, applications, platform or services, you agree to comply with these Terms of Use and all applicable laws.

If you do not agree with these Terms, you should not use Nirmaara.

Where a user creates an account, submits an application, purchases a membership or otherwise uses a feature that requires acceptance, the user confirms that they have read and accepted the applicable terms.

Nirmaara is intended for adults, customers, businesses, professionals and other persons legally capable of entering into contracts.

Users must provide accurate information and must not create an account on behalf of another person without appropriate authority.

If you are using Nirmaara on behalf of a company, firm or organisation, you represent that you have authority to act on behalf of that organisation.

Nirmaara is a technology-enabled professional discovery and connection platform.

Customers may use Nirmaara to:

• Search for construction professionals
• Search by city, location, expertise and project requirements
• View professional profiles
• View professional portfolios and project information
• Shortlist professionals
• Submit project requirements
• Request contact or connection with professionals
• Communicate with professionals through available platform features

Professionals may use Nirmaara to:

• Create a professional profile
• Display their expertise and services
• Submit project and experience information
• Complete applicable verification processes
• Receive customer enquiries
• Respond to customer requirements
• Purchase professional membership or other applicable services

Unless expressly stated otherwise, Nirmaara does not:

• Provide architectural services
• Provide construction services
• Employ contractors or labour contractors
• Execute construction projects
• Supervise construction projects
• Guarantee project completion
• Guarantee workmanship
• Guarantee project cost or timeline
• Enter into construction contracts on behalf of professionals
• Act as the customer's architect, contractor, consultant or project manager

Professionals listed on Nirmaara are independent individuals, firms or businesses.

Any construction, architectural, consultancy, labour or other professional engagement is between the customer and the professional concerned.

Nirmaara is not a party to any agreement between a customer and a professional unless Nirmaara expressly states otherwise in writing.

Nirmaara may list different categories of construction professionals, including:

• Architects
• Turnkey Contractors
• Specialized Contractors
• Labour Contractors
• Other construction-related professionals introduced by Nirmaara in the future

Different categories may have different application, verification, documentation, membership and eligibility requirements.

Professional profiles may contain information submitted by professionals, including:

• Experience
• Expertise
• Project history
• Project photographs
• Service areas
• Project sizes
• Project values where applicable
• Types of projects undertaken
• Testimonials
• References
• Business information
• Verification information
• External business links
• Other information voluntarily submitted by the professional

Professionals are responsible for the accuracy of the information they submit.

Nirmaara may review or verify certain information submitted by professionals.

Nirmaara may conduct different forms of verification depending on the professional category and the information submitted.

Possible verification areas may include:

• Identity verification
• Business verification
• GST verification where applicable
• Experience review
• Project review
• Reference checks
• Financial or turnover verification where applicable
• Other verification checks introduced by Nirmaara

A verification indicator relates only to the specific information, document, reference or criterion reviewed by Nirmaara.

A verification badge or status does NOT mean that Nirmaara guarantees:

• The professional's workmanship
• Future performance
• Financial capacity
• Project outcome
• Pricing
• Conduct
• Availability
• Regulatory compliance
• Suitability for a particular project

Users should independently evaluate professionals before entering into any agreement.

Customers are responsible for independently evaluating any professional before entering into an agreement.

Customers should independently consider:

• Quotations
• Contracts
• Scope of work
• Drawings and specifications
• Project timelines
• Payment schedules
• Licences and permissions
• Insurance
• Tax requirements
• References
• Previous projects
• Professional qualifications where relevant
• Applicable statutory approvals
• Other matters relevant to their project

Customers should not rely solely on information displayed on Nirmaara.

Customers are responsible for entering into appropriate written agreements with professionals and for making payments according to those agreements.

Professionals are responsible for ensuring that all information submitted to Nirmaara is:

• Accurate
• Current
• Complete
• Lawful
• Not misleading

Professionals must not:

• Submit false project information
• Fabricate references
• Upload photographs belonging to others without permission
• Make misleading claims
• Impersonate another person or business
• Submit fraudulent or forged documents
• Misuse customer information
• Misrepresent qualifications or experience
• Manipulate testimonials or reviews
• Use Nirmaara for unlawful purposes

Nirmaara may suspend, restrict, reject or remove a professional profile where information is found to be false, misleading, fraudulent, incomplete or otherwise inconsistent with Nirmaara policies.

Submitting a professional application does not guarantee approval or listing.

Nirmaara may review applications based on its eligibility, verification and quality criteria.

Nirmaara may:

• Approve an application
• Request additional information
• Request clarification
• Request documents
• Reject an application
• Place an application under review
• Suspend an approved professional
• Require information to be updated
• Remove a professional profile

Nirmaara may operate a process in which: Application → Review → Qualification/Approval → Membership Payment → Active Listing.

Approval and membership payment are separate stages unless otherwise stated.

Nirmaara may offer paid professional membership plans.

Applicable membership plans, pricing, taxes, duration and benefits will be displayed on the relevant membership page before payment.

Indicative plans may include:

• Professional / Turnkey / Specialized Contractor: Rs. 10,000 + applicable GST per year
• Labour Contractor: Rs. 5,000 + applicable GST per year
• Architect: As displayed on the applicable membership page.

Actual pricing applicable to a professional will be the price displayed at the time of purchase.

Unless expressly stated otherwise:

• Membership does not guarantee leads
• Membership does not guarantee projects
• Membership does not guarantee revenue
• Membership does not guarantee customer conversion
• Membership does not guarantee a particular search position
• Membership does not guarantee approval
• Membership does not guarantee professional quality

Nirmaara may change membership plans, pricing and benefits prospectively, subject to applicable law and any commitments already made to an existing member.

Nirmaara takes customer privacy seriously.

A customer's personal contact information will not be publicly displayed or disclosed to professionals except where:

• The customer has expressly consented
• Disclosure is necessary to facilitate a requested connection or service
• Disclosure is required or permitted by applicable law

Where appropriate, Nirmaara may facilitate communication through platform-based or masked communication mechanisms.

Labour contractors will not receive customer phone numbers by default.

The detailed handling of personal information is described in the Nirmaara Privacy Policy.

When a customer requests to connect with a professional, Nirmaara may:

• Notify the professional
• Share limited project information
• Facilitate communication through the platform
• Request customer consent before releasing personal contact details
• Record the connection for platform operations, support, security and analytics

A connection request does not constitute a contract, appointment, project award or guarantee that the professional will undertake the project.

Nirmaara does not guarantee that a professional will respond to a connection request.

Customers may submit project requirements containing information such as:

• City
• Area
• Project type
• Plot area
• Built-up area
• Number of floors
• Budget range
• Expected start date
• Expected timeline
• Required professional category
• Required expertise
• Description
• Drawings, photographs or documents

Customers should not upload confidential information unless necessary for the intended purpose.

Nirmaara may use project requirement information to identify and facilitate connections with relevant professionals.

Nirmaara may use project requirements and professional information to help customers discover potentially relevant professionals.

Matching or recommendation results may consider factors such as:

• City
• Service area
• Professional category
• Expertise
• Project type
• Project size
• Project value or range
• Experience
• Completed projects
• Verification status
• Other platform criteria

A match, recommendation, ranking or search result does not constitute an endorsement or guarantee by Nirmaara.

Nirmaara may modify its matching and search systems from time to time.

Users must not use Nirmaara to:

• Commit fraud
• Deceive another person
• Collect personal information unlawfully
• Send spam
• Harass or threaten users
• Upload malicious software
• Interfere with platform security
• Attempt unauthorised access
• Scrape or systematically extract platform data without permission
• Create fake profiles
• Manipulate reviews or testimonials
• Upload copyrighted material without permission
• Impersonate another person or organisation
• Submit forged or fraudulent documents
• Circumvent payment or membership systems
• Use another person's account without authorisation
• Use Nirmaara for unlawful activities
• Attempt to damage or disrupt Nirmaara or its users

Where Nirmaara allows reviews, testimonials or references:

• Users must provide truthful information
• Users must not submit fake reviews
• Professionals must not create or arrange fraudulent testimonials
• Users must not threaten or pressure another person to provide a particular review
• Content must not contain unlawful, defamatory, abusive or misleading material

Nirmaara may moderate, reject, remove or request clarification regarding reviews, testimonials or references.

A review or testimonial represents the opinion or experience of the person providing it and does not necessarily represent the views of Nirmaara.

Professionals may submit project photographs, descriptions, drawings or other portfolio material.

By submitting such content, the professional confirms that:

• They have the necessary rights or permissions to submit it
• The content does not unlawfully disclose another person's confidential information
• The content does not infringe third-party intellectual property rights
• Any required customer or project-owner permission has been obtained where necessary

Nirmaara may remove content where it receives a valid complaint or otherwise reasonably believes the content violates applicable law or these Terms.

Nirmaara's name, logo, branding, website design, software, databases, platform architecture, content created by Nirmaara, graphics, user interface and platform functionality are owned by or licensed to HungryNow Innovations Private Limited unless otherwise stated.

You may not copy, reproduce, modify, distribute, reverse engineer, commercially exploit or create derivative works from Nirmaara's proprietary material without prior written permission, except where permitted by applicable law.

By submitting photographs, project descriptions, business information, testimonials or other content to Nirmaara, you grant Nirmaara a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, adapt for technical presentation, distribute within the platform and use the content for operating, improving and promoting Nirmaara.

This licence continues for as long as reasonably necessary for Nirmaara's operational, legal and archival purposes, subject to applicable law and the Nirmaara Privacy Policy.

You confirm that you have the necessary rights and permissions to submit such content.

Nirmaara may use third-party services such as:

• Payment gateways
• Cloud hosting providers
• Communication providers
• Analytics providers
• Mapping services
• Identity verification services
• Business verification services
• Email and SMS providers
• Other technology service providers

Such services may have their own terms and privacy policies.

Nirmaara is not responsible for independent services provided by third parties except to the extent required by applicable law.

Payments for Nirmaara services may be processed through third-party payment gateways.

The applicable price, taxes and payment terms will be displayed before payment.

Users must provide accurate payment and billing information.

Nirmaara may record transaction information such as transaction ID, amount, payment status, date and refund status.

Payment credentials may be processed by the applicable payment provider.

Refunds and cancellations for paid Nirmaara services are governed by the Nirmaara Refunds & Cancellations Policy.

The Refunds & Cancellations Policy forms part of these Terms by reference.

Users should review that policy before making payment.

Nirmaara aims to maintain a reliable and accessible platform.

However, Nirmaara does not guarantee that the platform will always be:

• Uninterrupted
• Error-free
• Available
• Secure against every possible threat
• Compatible with every device

Maintenance, technical problems, third-party failures, internet/network problems or circumstances beyond our reasonable control may temporarily affect availability.

Nirmaara does not guarantee:

• Construction quality
• Project completion
• Project profitability
• Project cost
• Project timelines
• Contractor availability
• Architect availability
• Labour availability
• Professional behaviour
• Regulatory approvals
• Successful completion of a customer's project

Nirmaara's role is to provide technology and discovery/connection services.

Any agreement for construction or professional services should be entered into directly between the customer and the selected professional.

Unless expressly stated otherwise, Nirmaara is not a party to contracts entered into between customers and professionals.

Customers and professionals are responsible for agreeing upon:

• Scope of work
• Fees
• Payment schedules
• Materials
• Labour
• Timelines
• Deliverables
• Warranty obligations
• Taxes
• Approvals
• Dispute resolution
• Other contractual terms

Nirmaara does not control payments made directly between customers and professionals.

To the maximum extent permitted by applicable law, Nirmaara shall not be responsible for indirect, incidental, special, consequential or loss-of-profit losses arising from interactions between customers and professionals.

Nirmaara shall not be responsible for losses resulting from:

• A professional's actions or omissions
• A customer's actions or omissions
• Construction defects
• Project delays
• Cost overruns
• Disputes between users
• Professional misconduct
• Incorrect information submitted by users
• Third-party service failures

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, users agree to indemnify and hold harmless HungryNow Innovations Private Limited, Nirmaara and their directors, officers, employees and service providers from claims, losses, liabilities, damages, costs and expenses arising from:

• Their violation of these Terms
• Fraudulent or misleading information submitted by them
• Their unlawful use of Nirmaara
• Their infringement of third-party rights
• Their misuse of another user's information
• Their contractual or commercial disputes with another user

Users are responsible for maintaining the confidentiality of their login credentials and for activity carried out through their account.

Users should immediately notify Nirmaara at support@nirmaara.com if they believe their account has been compromised or used without authorisation.

Nirmaara may require additional verification to protect an account.

Nirmaara may suspend, restrict or terminate access where a user:

• Violates these Terms
• Provides false information
• Engages in fraudulent conduct
• Misuses customer or professional information
• Compromises platform security
• Engages in unlawful activity
• Materially harms the platform or its users
• Fails applicable professional verification requirements
• Uses Nirmaara in a manner inconsistent with its intended purpose

Where appropriate, Nirmaara may provide an opportunity to correct or clarify information.

Suspension or termination may occur immediately where necessary to protect users, the platform, security or legal interests.

Upon termination:

• The user's access to applicable platform features may cease
• Professional listings may be removed or made inactive
• Pending requests may be cancelled or closed
• Information may be retained where required for legal, security, accounting or legitimate business purposes
• Any outstanding obligations that by their nature should survive termination will continue to apply

Use of Nirmaara is also subject to the Nirmaara Privacy Policy.

The Privacy Policy explains how personal information is collected, used, stored, shared and protected.

Nirmaara will use reasonable measures to protect personal information.

Users must not:

• Copy customer phone numbers or personal information for unauthorised use
• Contact users outside the intended purpose of a connection
• Sell or share another user's personal information
• Use Nirmaara information for spam or unsolicited marketing
• Attempt to bypass Nirmaara's privacy controls

Misuse of personal information may result in suspension or termination and may be reported where required by law.

Nirmaara may communicate with users through:

• Email
• SMS
• Phone
• WhatsApp or other messaging services where enabled
• In-platform notifications
• Other communication methods

Service-related communications may be necessary for account operation, security, verification, payment, membership and connection requests.

Marketing communications will be handled subject to applicable law and available opt-out mechanisms.

Nirmaara may modify, add, remove or discontinue platform features from time to time.

This may include changes to:

• Search
• Matching
• Professional profiles
• Verification processes
• Membership plans
• Notifications
• Customer dashboards
• Professional dashboards
• Other platform functionality

Where required by law, appropriate notice will be provided.

Nirmaara may update these Terms from time to time.

Updated Terms will be published on this page with a revised "Last Updated" date.

Where required by applicable law, Nirmaara may provide additional notice for material changes.

Continued use of Nirmaara after an update constitutes acceptance of the updated Terms to the extent permitted by applicable law.

These Terms shall be governed by the laws of India.

Subject to applicable law, courts having appropriate jurisdiction in Pune, Maharashtra shall have jurisdiction over disputes arising from these Terms.

Nothing in this clause prevents a consumer or other user from exercising any statutory right to approach a forum or authority that has jurisdiction under applicable law.

If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions will continue to remain in effect to the extent permitted by law.

These Terms, together with the Nirmaara Privacy Policy, Refunds & Cancellations Policy and any additional terms expressly applicable to specific services, constitute the applicable agreement governing use of Nirmaara, subject to applicable law.
